Do you believe LJ Hooker can sell a property without your authorization?

Yes. It happens.

My pregnant wife searched and inspected to buy a property for a couple of months, she couldn’t drive at that time and took trains or buses, walked long distance every time, finally, signed a contract and ended by a tricky transaction. She wept for more than ten times as she loves this location and property, so I have to expose this for others’ care.

Person 1 : J Chen,   my wife

Person 2 : Min Zhu,  me

Person 3 : Idrees Khan Sher,  the property owner, never been contacted with.

Person 4 : Amer Malik,  The salesperson and the owner of LJ Hooker Ingleburn.

In the meeting with Amer Malik on September 12,2014, I recorded.

1. Here is Amer’s voice:

2. Amer admitted he let “the vendor’s father” sign the agreement for sale, haven’t checked the power of attorney.

(I want to say:  why do you think the man is the property owner’s father, just because of the same surname?)

3. Amer got the keys from the “father”, did inspection and advertisement, never contact with the real owner.

(I want to say: Does he mean if a person has keys, then he has right to sell a property?)

4. Amer told that, the “father” claimed the exchanged contracts were not signed by the real vendor, but by another person he asked. Amer can’t verify anything, because the vendor is like a suppositional person, without any mobile number, signature or ID copy. (The mobile number on the contracts belongs to the “father”)

(I want to say: How ridiculous! Do you believe it comes from a famous property agent in Australia?)

5. Without any power of attorney, Amer sent the contract to the “father”’s email to sign, and let the “father” to be a witness, then changed contracts without vendor’s original contract and received our deposit of 10%.

Our solicitor did all jobs for conveyance, and after we found team of renovation, preparing the birth of our first baby, but the settlement is hanging.

The agent told us the vendor still insists on another open home during the weekend.

The agent texted us that the vendor was agree to sign the contract at the price $430,000
05 / 08 / 2014
The agent informed us the vendor has signed the contract, he would send the contract to our solicitor.

The agent emailed us “contracts have exchanged”.

Our solicitor received the fax of the vendor’s solicitor for asking to delay the settlement.

We paid 10% deposit $43,000 to the Agent’s trust account.

The agent told us that the vendor wants to delay the settlement for another 2 months. If we are agree, compensation should try to be claimed by the agent from the vendor.

The agent advised that the vendor refused the pre-settlement inspection for his claiming the contracts are illegal by misleading.

“The vendor’s father” Mr. Sher Aftab Khan visited our home suddenly, claimed
  1. The contracts are illegal by misleading and not being authorized from the real vendor.
  2. The signature of the vendor is not the real vendor’s. He let the 3rd person to sign in the “vendor”.
He refused to give the contact details of the real vendor Idrees Khan Sher when we want to contact the real vendor to verify.

We had a meeting with the agent and confirmed that the agent did not have the power of attorney from the real vendor Idrees Khan Sher.

We were advised by our solicitor that someone (“the vendor’s friend”) called them to check the contract is original or not. We visited our solicitor’s office and found the contract is seemed to be a copy one.

Our solicitor advised us the vendor’s solicitor hadn’t answered any email or fax.

We visited the Legal Aid in Liverpool, the lawyer advised us that they cannot give any ideas because of the conflict of the interest, suggesting us to look for other lawyers.

The vendor’s solicitor answered our solicitor by fax and stated that “We also note that presently our office is having difficulties receiving further instructions from the vendor; accordingly we cannot advise on when the settlement is likely to take place.”

We received a letter from Mr. Sher Aftab Khan to claim like what he claimed on September 9.

Our solicitor sent notice of completion (ended on 17 Oct) to the vendor’s solicitor and the vendor (to the address on the contract).

No response from any party.
